James Butler of Dowganstown, Parish of Clodagh Co. Carlow, and Tullow als Tullophelin in the Parish of same Barony of Rathvilly Co Carlow.

James Butler, 2^nd son of Pierce Butler of Kayer, Co Wexford, and Margaret Devereux, was in all probability of age when his father died in 1599 (his elder brother Edward then being 22. viz. born 1577) (Inquisition Co Wexford No 18 Jas I)

Deed of Enfeoffment c 1608 being MS of Ellen Butler of Kayer to Edmund Baron of Brownsford Co Kilkenny has come into the hands of Margaret Butler als Devereux her mother and James Butler of Tullophelin Co Carlow her brother (see also CB 2789).

About 25 years ago Suplt being in quiet possession of the lands (part) Co Tipperary owing to late wars Suplt was forced to lease premises. Writing which could prove the justice of Suplts claim is in possession of James Butler of Moneyhore Co Wexford who has made fraudulent conveyance of the premises and Suplt has no power to redress Butlers alliance in the said county being so great (See also Book of Civil Survey Co Tipp. Parish of Tirreglasse Barony of Lower Ormond)

20 Aug 1624 he was a party to a feoffment by Sir Thomas Colclough of Tintern Abbey Co Wexford of his estates in the county Carlow (Inq. Co Carlow at Tullow 10 Chas I dated 20 March 1626)

1 Aug 1626: Pardon of an alienation made by Robert St Leger of a moiety of the town of Dowganstown in the County Catherlagh to James Knolls, merchant and by him conveyed to James Butler (Morris Vol 3 p90)

2 April 1627. Lease Walter Earl of Ormond to James Butler of Tulleophelim Co Carlow & Rowland Eustace son & heir of Oliver Eustace of Ballygriffin Co Dublin of the lands of Tankardstown, Coppermagh, Killinogarvoge and the castle of Ardriscon Co Catherlagh for 61 years at ₤60 per an.

21 July 1629. Edward Butler of Kayer Co Wexford died 8 Oct 1628, mentions James Butler brother of said Edward (Inq. Co Wexford No 35 Jas I Chas)

He was a Justice of the Peace for County Carlow “James Butler of Tully Esq.” (Ormond Deed No 3794 A dated 8 March 1630/1)

10 Feb 1629 he died; in the inquisition post mortem he is described as of Dowganstown and Garryyard (New Garden- see Book of Survey & Distribution) (Inq Co Catherlagh No 24 Chas I dated 13 April 1631)

WILL- Feb 1629- His will as James Butler of Dowganstown was proved in the Prerogative Court, 8 Nov 1629.

Wife Ellane

Children: Edward, Walter (exor), Theobald, Gilbert, Thomas, Derbell (Isabella), Jennett.

Brother (in law) Gennett.

Cousins: Captain Brien. Edward Butler Knt.

Place Names: Dowganstown, Garinor, Okedaghbennett Castle greet (Castlegrace), Derdiveseten, Kilmogarnage, Copnaghe, Tankardstown.

Executors- Wife and son Edward (recte Walter see CB 24 Feb 1640)

He married Ellen illegitimate daughter of Edward Butler of Cloghinch (Ballynahinch) Co Tipperary, 6^th son of James 9^th Earl of Ormond. (Carew MSS 626 p128)

She is mentioned in his will dated 7 Feb 1629 and in his inquisition post mortem of 13 April 1631

And she was a defendant in the Chancery Bill of 24 Feb 1640 when she is accused by her son and heir Edward of withholding from him the bond of his marriage settlement dated 5 June 1640.

According to Gen. Office Pedigree No 27, page 276, he was High Sheriff of Carlow 1646.

They had issue- five sons and two daughters Viz:

1 1.Edward Butler of whom hereafter.

2 2.Walter of Coppenagh Barony of Rathvilly Co Carlow which was held from the Earl of Ormond by lease to his father dated 2 April 1627 (OD 3692).

He was appointed executor with his mother of his father’s estate although a minor when he died in 1629.

7 Sept 1642 he is accused in the Deposition of Lady Anne wife of Sir Thomas Butler of Rathhelin Co Carlow 1^st Bart, of having besieged Sir Thomas house on St Patrick’s Day 17 March 1642 along with 6 or 700 and having burned down their house took them as prisoners to Leighlin Castle and from there to Kilkenny where they were brought before Lord Mountgarret who refused to have them executed (Depositions Co Carlow No CLVIII Hickson Vol 2 p51/2)

Edward Butler the eldest son was aged 21 when his father died (Inq Co Catherlagh No 24 Chas I) in 10 Feb 1629.

14 June 1632 He had livery of his estates as Edward son and heir of James Butler late of Tullow Co Carlow deceased (Morris Vol 3 p602)

10 Aug 1638. Grant to Edward Butler of the lands etc. Of Dowganstown, Darryroe (?Garrryroe?) & Skeaghbennt in the county of Carlow at a chief rent of 7/6 per ann. (Lodge Register Vol 1 Chas II p105)

24 Feb 1640 Edward brought an action against his mother Ellen Butler for possession of the title deeds and feoffment of Tullaghphelim, Rathlaghan, Dawnyus, & Ballybreeken Co Carlow which formed part of his marriage settlement of 5 June 1626 and which he claimed that she and his brother Walter withheld from him (Chancery Bill).

According to the extracts from the will of his father Edward was named as executor but this he denies in the above bill and says that his mother and brother Walter were executors (Butler Will No 196 & CB)

Edward died before 23 Oct 1641 when his son and heir James is shown as proprietor of the family estates (Civil Survey and Book of Survey and Distribution for Carlow and Tipperary)

29 July 1641 Edward Butler, now High Sheriff of the County Carlow (Ryan’s History of Co Carlow p.162). If this is our Edward then he died July-October 1641.

Edward married MS 5 June 1626 Gennett daughter of Oliver or Glyter Eustace of Ballymoney Co Carlow and Ballygriffen Co Dublin (CB 24 Feb 1640 & OD[Ormond deeds] No. 3692)

From this point TBB follows Gen Office Pedigree, Vol. 27, P.276/7 which is printed in Misc. Her. And Gen. 3^rd Series Vol. 5 p. 115/6. In neither case are any authorities given.

James Butler the eldest son of Edward Butler, was Proprietor in Oct 1642 of Dowganstown and Newgadden, Parish of Clodagh, Barony of Catherlagh, 271 acres this property was granted to Richard Andrews for Peregrine Pretty (Bk of Survey etc), and of N(?K)eivyre 241 acres and Rorane 25 acres which were granted to the Earl of Cork. These last tow in the parish of Tirraglass Barony of Lower Ormond 9Bk of Survey)

James forfeited his estates under the English Act of Parliament of 11 Oct 1652 for rebellion.

Sept 1653 to July 1654 he had a tranplanter’s certificate from the precincts.

Dec 1641- According to the Deposition of Ralph Buckley of Carlow James Butler of tullow Esq. and most of the Irish Gentry joined the rebellion but as he was only at most 16 years old at that time this seems unlikely (Deposition Co Carlow No CLXXII Hickson Vol. 2 p79)

James Butler of Tullogh Co Carlow had no certificate from the Athlone & Loughrea Commissioners. But Ormond MSS Vol. 2 p.125 gives the following:

Thomas Bagnall and Jane his wife and Nicholas Bagnall an natural idiot and brother of the said Thomas Bagnall of Donganstown Co Catherlough Decree 1 April 1656. Final Settlement 19 Aug 1656 378 acres.

? Was the above Jane Bagnall the daughter and heir of James Butler of Dowganstown (see BTR 70 and 242)

(Editor’s note- Thomas and Jane Bagnall’s daughter Jane married Edward Butler of Moneyhore Co Wexford, son of Pierce Butler of Kayer- see BTR 70)

The next and last notice found on the Dowganstown family is in the forfeitures of 1691 for rebellion as at 21 June 1688. Edward Butler of Dowganstown Co Carlow, but no claim appears to have been made against his estate at Chichester House in 1700.

Returning to Gen Office Pedigree Vol 27 p276/7 which was registered at the old Office of arms by the late G.D. Burtcheall 24 April 1902, this reads as follows (omitting the early part):

Edward eldest son of James (ob. 10 Feb 1629) was of Tullow Co Carlow, born 1618. High Sheriff of Co Carlow 1641. Slain at the Battle of ross 18 March 1643/4, and had issue James of Tullow who forfeited Dowganstown and New Garden Co Carlow in 1653 and had issue Edward of Dowganstown who forfeited in 1691/2. He had issue James of Tullow who married Eleanor daughter of ___ Eustace of Yeomanstown. They had issue Walter Butler of Tullow who married Eleanor daughter of William Talbot of Castle Talbot Co Wexford. They had issue James of Tullow born 1719 ob 18 Nov 1796, aet 77, married Alice 2^nd daughter of Christopher Byrne of Kilmagar Co Kilkenny. She was born 1729 died Nov 1801 Will (Leighlin) dated 1 Nov 1801, probate 26 Jan 1802. They had issue 2 sons and 2 daughters Viz.:

1 1.Walter Butler of whom hereafter

2. Henry

3. Mary married William Keating of Ballyharrin Queens Co. (He born 1742 died 1828)

4. Sarah who married ____ Ninton

Walter the eldest son married twice- 1stly Anna dau of James Brennan of Briskanclare (?) co Kilkenny, by whom he had issue of whom hereafter, and 2ndly Rebecca daughter of the Rev. John Waring of Pottlerath Co Kilkenny. Her will dated 12 Dec 1828 proved 12 June 1830 at Kilkenny.

Walter had issue by his first wife, a son and 2 daughters, Viz.:

1 James of Kilmagar Co Kilkenny married Harriet dau of Peter Strange of Aylard, Aylwardstown Co Kilkenny. His will dated 2 Aug 1854 probate 21 Nov 1854. They had issue:

1. Walter Fleming Butler the only son; and a. Anne; b. Maria; c. Julia

Clues- He m. Antoinette Foszez (d. 23 July 1823). He d. 26 Feb. 1828, in Livonia at Zakrzewszczyzna where his son, Vincent had been born, 9 Oct. 1810 (per M. Junqua of Paris).

136. BJ2#1 Jan Butler (d.1828) of Poland

The best known Irish Butler in Poland was Col. James Butler (d.1634) who was probably a son of James (d.1629) of Dowganstown, Co. Carlow, 2nd. s/o Pierce, 2nd. s/o Richard, 1st. Viscount Mountgarret. Col. James was created a Count of the Empire in 1627 and eventually settled in Poland with his wife and children. From, him are believed to descend Joseph and Antoine Butler, both of whom, in 1824, had their titles confirmed as Counts of Poland.

Colonel James Butler, possibly a son of James Butler of Dowganstown, was in Polish service against Russia in 1617-18. In 1619, he travelled back to Ireland to recruit men and brought back 300 men to Poland. They fought against Swedish forces in 1622 in Livonia. In 1625 he commanded a 400-men regiment of dragoons in the Polish Quarter Army fighting against the Cossacks. He had his noble status confirmed in Poland-Lithuania in 1627, and fought in campaigns against the Swedes in Prussia in 1626-29. By 1630 he was recruiting troops for the Imperial Service and served with his kinsman Colonel Walter Butler of Paulstown (the Wallenstein assassination incident in 1634). He returned from Imperial service in 1633 and led a 1000 strong regiment of infantry against the Muscovites and was highly praised for his valour in the 1633-34 campaign. It is uncertain what happened to him after this, but his descendants continue to live in Poland.
